Do you know... that most auto accident cases in New Mexico are negligence cases? You need the following things to have a viable case:
- A duty owed to you. For example, all drivers have a duty to stop at
red lights unless there is a very special reason for not stopping.
- A violation of the duty. A driver runs a red light without justification.
- Damages. Most auto accidents have property damage (damage to cars,
fences, etc.) and personal injuries ("whiplash", broken bones, death,
pain and suffering, emotional damages, etc.). The best evidence of
damages are medical records and bills from competent and trustworthy
healthcare providers.
- The violation of the duty caused the damages. Either the damages
must have a self-evident connection to the accident or a doctor states
that there is such a connection or both. Prior injuries can cloud this
part of the case.

Do you know... what you should do in case of an auto accident?
- If possible move the vehicles to a safe place away from traffic.
- Call the police.
- If you have the knowledge and it is necessary, give first aid.
- Get medical treatment as soon as possible. Use an ambulance if
necessary. Even if you feel well, you should still see a doctor because
your injuries may be hidden or slow in revealing themselves.
- If possible exchange information will the other drivers involved.
- Get the names, badge numbers and phone numbers of all police
officers involved.
- Get a copy of the police report as soon as possible.
- Report the accident to your insurer. If you don't have insurance get it
immediately. You should have at least $100,000.00/$300,000.00 in
liability coverage. You should have at least the same in under
insured/uninsured coverage.

- Don't settle with the insurer until you have contacted a lawyer to
